This agreement
These terms are an agreement between you and Chronoix, LLC, and they govern your use of the Chronoix apps for iPhone and Apple Watch and the watch faces you buy in them. By downloading or using Chronoix, you accept them.
This agreement is with Chronoix, not with Apple. Chronoix alone is responsible for the app and its content.
These terms do not conflict with the Apple Media Services Terms and Conditions. Where this agreement gives you less than those terms do, those terms apply.
What Chronoix is
Chronoix designs watch faces for Apple Watch. You browse them on your iPhone, buy the ones you want, and the app builds each one and sends it to your watch. Some dials display Health and fitness values that are read on your own devices.
Your licence
When you buy a dial, you get a personal, non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
The licence follows your Apple Account, not a single watch. You can install a dial you bought on more than one Apple Watch paired to you, and it is available through Family Sharing where Apple allows it.
What the licence does not allow
- Reselling, renting, sublicensing or redistributing a dial, on its own or as part of something else.
- Extracting the artwork, layouts or design files from a dial to reuse them elsewhere.
- Copying or imitating a dial to publish it in another store or platform.
- Reverse engineering, decompiling or disassembling the app, except where the law expressly allows it despite this restriction.
- Using Chronoix in a way that breaks the law or infringes someone else's rights.
Purchases and payment
Apple handles every purchase, payment method, restoration, refund, Family Sharing and Ask to Buy. Prices are the ones shown in the app at the moment of purchase, in your local currency, and Apple collects the payment. Chronoix receives only the confirmation that unlocks a dial for you, and never your card number or your Apple Account password.
Dials are one-time purchases. There is no subscription and no Chronoix account.
Refunds
Refunds are handled by Apple under its own policies. Request one at reportaproblem.apple.com. Chronoix cannot issue a refund directly. If something is not working, write to us first — we would rather fix it.
What you need
An iPhone and a compatible Apple Watch, paired with each other, and a recent version of their operating systems. Compatibility is described in the Help Center. Some dials depend on watch faces that Apple does not offer on every model, and those cannot be installed where Apple does not offer them.
Health and fitness information
Chronoix shows Health and fitness information for personal reference only. It is not a medical device and must not be used for diagnosis, treatment, or in an emergency. Values come from Apple Health and from your watch, and they can be delayed, incomplete or unavailable. Do not make health decisions based on what a watch face shows.
How that information is handled is described in the Privacy Policy.
Weather information
Weather shown on a dial is provided by Apple Weather and other data sources. It is a forecast, not a measurement: it can be delayed, approximate, or wrong. Do not rely on it for safety decisions — for severe weather, use an official source from your national meteorological agency.
Chronoix does not produce this data and does not warrant its accuracy. What happens to your location when a dial shows weather is described in the Privacy Policy.
Maintenance and support
Chronoix is solely responsible for providing any maintenance and support for the app. Apple has no obligation whatsoever to furnish maintenance or support services. Write to support@fanawatch.com.
Warranty
Chronoix is responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed.
If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Chronoix's responsibility.
Claims
Chronoix, and not Apple, is responsible for addressing any claim from you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
Intellectual property
The app, the dials and their designs belong to Chronoix, LLC and are protected by copyright. Buying a dial licenses its use; it does not transfer ownership.
If a third party claims that the app or a dial infringes their intellectual property rights, Chronoix, and not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance
By using Chronoix you represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third party terms
You must comply with any applicable third party terms of agreement when using Chronoix — including the Apple Media Services Terms and Conditions, and the terms of your mobile network or internet provider.
Apple's role
Apple and its subsidiaries are third party beneficiaries of these terms. When you accept them, Apple has the right — and is deemed to have accepted the right — to enforce these terms against you as a third party beneficiary.
Disclaimers
To the maximum extent permitted by law, Chronoix is provided "as is" and "as available", without warranties of any kind. We do not warrant that the app will be uninterrupted or error-free, that every dial will remain available, or that a value shown on a watch face will always be current or accurate.
Nothing here excludes rights you have under the mandatory consumer law of your country.
Limitation of liability
To the maximum extent permitted by law, Chronoix, LLC is not liable for indirect, incidental, special or consequential damages, or for lost data or lost profits, arising from your use of the app.
Where liability cannot be excluded, it is limited to the amount you paid to Chronoix for the dials in question in the twelve months before the claim.
Ending this agreement
You can end this agreement at any time by deleting Chronoix from your devices. We may end it if you materially breach these terms, in particular the restrictions in What the licence does not allow. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability and governing law — continue to apply.
Changes
We update these terms when the product or the law changes. The effective date at the top always shows the current version. Continuing to use Chronoix after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. This does not deprive you of the protection of the mandatory consumer law of the country where you live.
